Terms of Access 

By accessing the A-CTEC online LMS via the ‘myopenlms’ website for the purposes of accessing A-CTEC learning courses or any other A-CTEC material, you agree that you have read and agree to be bound by the terms and conditions set out below. Please seek independent legal advice if you have any questions or concerns about these terms and conditions before accepting them. 

You further agree to the following: 

  • Collection and use of your private information as described in the Privacy Policy
  • The personal data you provide upon registration is accurate
  • You agree to receiving communications from A-CTEC via your registered email. 

Changes to Content and Terms 

A-CTEC may in its absolute discretion (and without notice) change these terms and conditions at any time, including (but not limited to) changes to the LMS, such as course content and other services.

Privacy Policy

A-CTEC has a Privacy Policy (see appendix 1 below) and a “Collection and use of your Personal Information” statement that is issued to all users upon registration to the LMS. If you would like further information, please contact the platform administrator on A-CTEC@unimelb.edu.au 

Creative Commons 

You agree that A-CTEC (or listed contributing partner/s) is/are the rightful owner/s of any intellectual property in the content of the A-CTEC LMS where online course content is hosted. A-CTEC is an authorised user of the software which underpins the A-CTEC LMS pursuant to a licence agreement with third parties.

With exception of template content, work hosted on A-CTEC is licensed under the following licence:

You are permitted to use material on the A-CTEC LMS for the purpose of undertaking A-CTEC education offerings, and for furthering the clinical trials education of yourself or others under the following license terms.

  • Attribution — You must give appropriate credit, provide a link to the license, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use.
  • NonCommercial — You may not use the material for commercial purposes.
  • NoDerivatives— If you remix, transform, or build upon the material, you may not distribute the modified material.

The A-CTEC LMS regularly displays hyperlinks to other websites outside of the LMS. You agree that this does not in any way imply that A-CTEC is a supporter of or has any affiliation, relationship, partnership or otherwise with that external body, and the goods and/or services offered by that body, nor do we exercise any editorial control over the content of those external websites. You are encouraged to read any further terms and conditions that may govern your use, access or otherwise of these external websites.

LMS functionality

You acknowledge that whilst every reasonable effort has been made by A-CTEC to ensure the successful operation of the LMS, subject to your Statutory Guarantee Rights (discussed below) and otherwise to the extent permitted by law, A-CTEC cannot and does not guarantee that the LMS (and any other application management systems) will operate free of errors (including any security breaches) or any other technicalities that may impede its functionality at all times of operation. Subject to your Statutory Guarantee Rights (discussed below) and otherwise to the extent permitted by law: 

  • You agree that your use of the LMS (and any other application/ management systems) is at your own risk, and you should be aware of this prior to using that application and this Website for the purposes of your use; and 
  • A-CTEC does not accept any responsibility, and cannot guarantee, the security of information sent by you or on your behalf as part of your use (or otherwise) to A-CTEC including via the Internet or any other means.

Warranties and Statutory Guarantee Rights 

You acknowledge that you enter into these terms and conditions freely and voluntarily based upon your own information, legal advice, and/or investigation. You have rights under the Australian Consumer Law, as defined in the Competition and Consumer Law Act 2010, ('Statutory Guarantee') for any loss or damage you suffer in connection with the A-CTEC LMS (and any other application management system) but, A-CTEC and its officers otherwise accept no responsibility to you for that loss or damage. To give legal effect to the foregoing: (a) you waive any rights you have or may have against A-CTEC and its officers in respect of any Claim in connection with the A-CTEC LMS (and any other application management system) in respect of which A-CTEC acts as an agent for its officers and holds their respective rights hereunder on trust for those officers; (b) nothing in these terms and conditions excludes, restricts or modifies, or has the effect of excluding, restricting or modifying, the application of, or your exercise of the Statutory Guarantees or any liability of A-CTEC for failing to satisfy the Statutory Guarantees in connection with the LMS (and any other application management system), where to do so would have the effect of rendering the relevant provision in these terms and conditions void or otherwise unenforceable; and (c) subject to paragraph (b) (above), any condition, warranty or guarantee implied by law is excluded from these terms and conditions and the liability for a breach of any Statutory Guarantee is limited to the full extent permitted by law, where Claim means any claim, allegation, suit, action, demand, cause of action or proceeding (including any prosecution, in which the prosecuting authority seeks a pecuniary penalty), irrespective of when it arises, whether or not it is actual or contingent and whether or not it is at law (including under contract or tort), in equity or under statute. 

Cancellation Policy

A-CTEC has the right to cancel a webinar or training session due to unforeseen circumstances such as low registration/attendance numbers.

General 

If any part of these Terms are held to be invalid and/or unenforceable, that part shall be severed from the Terms, and the remainder of these Terms will continue to be valid and enforceable.


Appendix 1 - Privacy Policy

About A-CTEC

A-CTEC is a collaboration of the following partners, the three Victorian Research Translation Centres – Melbourne Academic Centre for Health, Monash Partners Academic Health Science Centre and Western Alliance, Parkville Cancer Clinical Trials Centre, Murdoch Children’s Research Institute, Victorian Comprehensive Cancer Centre and Alfred Health. 

Each State and Territory in Australia have an entity who has paid for access to A-CTEC on behalf of all users. Should you wish to know who the paying entity is for your state please contact the platform administrator A-CTEC@unimelb.edu.au 

Collection and Use of Personal Information

Upon registration with A-CTEC an individual’s name and affiliated organisation are collected. This information will by used for a A-CTEC distribution list to update users of new information and amendments to content. It will also be provided to the entity who has paid for access for their respective state or territory for reporting training activity to comply with the National Clinical Trials Governance Framework and other Government reports on workforce training. This information may be provided to your employer if requested for the purpose of credentialing for the conduct of clinical trials and Good Clinical Practice. 

Disclosure of Personal Information 

Information will not be shared with any third parties unless;

  • The individual has consented.
  • It would be reasonably expected that this information is passed on
  • It is required by law
  • For use in A-CTEC mailing lists 
  • For reporting as per the use of personal information above 

Data Security

The data will be hosted on AWS Sydney Servers. The data stays within Australia and is not migrated to other regions.
